Il 1^ maggio 2014 dalle 16,45 alle 18,45 si terrà presso lo Studio Ashford LLP di Londra un incontro dal titolo “Mediazione obbligatoria – Un esperimento utile?”. Tra i molti relatori, esperti e mediatori internazionali, il Prof. Giuseppe De Palo, presidente di ADR Center, Roma, che presenterà i punti chiave del recente studio sulla mediazione commissionato dal Parlamento Europeo.

In particolare l’appuntamento sarà dedicato al tema del “paradosso della mediazione in UE”, ovvero le ragioni del travagliato percorso della mediazione civile e commerciale in Europa nonostante i riconosciuti vantaggi ad essa legati.

Il Parlamento Europeo ha commissionato infatti uno studio teso a dimostrare che il deludente risultato dello strumento di risoluzione alternativa delle controversie deriva dalle deboli politiche attuative a livello legislativo e promozionale in quasi tutti gli stati membri.

‘Rebooting’ the EU Mediation Directive
It is six years since its adoption, but the Mediation Directive (2008/52/EC) has not yet solved the ‘EU Mediation Paradox’. Despite its proven and multiple benefits, mediation in civil and commercial matters is still used in less than 1% of the cases in the EU.
The European Parliament commissioned a study which solicited the views of some 816 experts from all over Europe, which clearly showed that this disappointing performance results from weak pro-mediation policies, whether legislative or promotional, in almost all of the 28 Member States.
The experts strongly supported a number of proposed non-legislative measures that could promote mediation development. But more fundamentally, the majority view of these experts suggested the introduction of a ‘mitigated’ form of mandatory mediation is worth experimenting with.
